LOS ANGELES—In response to a Temporary Restraining Order earlier this month by retired porn star Lisa Ann, adult performer Nikki Benz has stated that she filed an anti-SLAPP motion in court yesterday, and that a hearing on the motion is scheduled for March 26 in LA Superior Court.
An motion is an attempt to strike a frivolous lawsuit, which is what Benz claims Lisa Ann's action against her amounts to. The motion seeks legal fees and the striking of any proceedings filed by Lisa Ann.
Benz further asserts that any tweets or statements she may have made about Lisa Ann are protected First Amendment speech, and that any legal papers filed by Lisa Ann were ''nothing more than an attempt to garner publicity... by an adult entertainer who is starved for attention.''
In a statement by Benz issued today, she adds that the anti-SLAPP motion is supported in part by declarations from adult entertainers Jayden Jaymes and Jesse Jane.
"I take the filing of Lisa Ann's frivolous case against me very seriously and intend to aggressively pursue all legal options against her, including the recovery of all my legal fees," said the star. "The action she filed was a publicity stunt—nothing more, nothing less. I am looking forward to our day in court.''
